Terms of Service

These Terms of Service ("Terms") govern your access to and use of Supapost (the "Service"), including the website at supapost.com, the web application, the API, and any related tools or services we provide.

The Service is operated by an individual sole trader based in the United Kingdom ("we", "us", "our"). You can reach us at [email protected].

By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at the email above if you suspect unauthorised access.

2. What the Service does

The Service lets you:

  • Generate images, video, characters, and written content using third-party AI models;
  • Build and edit content such as slideshows, posts, and short video;
  • Connect third-party accounts (for example TikTok, Instagram, YouTube, X, Shopify, or Etsy) to schedule and publish content; and
  • Store and manage the content you create within the Service.

Features, models, limits, and pricing may change. We may add, remove, or modify any part of the Service at any time.

3. Your content

"Your Content" means any prompts, images, video, audio, text, characters, brand assets, or other material you upload, generate, or publish through the Service.

You retain all rights you already have in Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display, and process Your Content solely to operate, secure, and improve the Service, including delivering content to third-party platforms at your instruction. This licence ends when you delete the content or close your account, except where retention is required to comply with law, to resolve disputes, or because of routine backups.

You are solely responsible for Your Content and for ensuring that you have all rights and permissions necessary to upload, generate, publish, and distribute it. You represent that Your Content does not infringe any third-party rights and complies with applicable law and with the rules of any connected platform.

4. AI-generated output

AI output is produced by third-party models based on your prompts and inputs. We do not guarantee that output is accurate, original, non-infringing, or suitable for any particular purpose. You are responsible for reviewing output before using, publishing, or distributing it.

The same or similar prompt may produce similar output for different users. To the extent we hold any rights in output generated for you, we assign those rights to you, subject to your compliance with these Terms and the terms of the underlying model providers.

5. Acceptable use

You agree not to use the Service to:

  • Generate or distribute content that is unlawful, defamatory, harassing, threatening, or that incites violence;
  • Generate sexual content involving minors, non-consensual sexual content, or deepfakes of identifiable real people without their clear permission;
  • Impersonate another person or entity, or misrepresent your affiliation with any person or entity;
  • Create content designed to mislead voters, influence elections, spread disinformation, or defraud others;
  • Infringe the intellectual property, privacy, publicity, or other rights of any third party;
  • Attempt to reverse engineer, scrape, resell, or abuse the Service, the API, or any underlying model provider;
  • Circumvent rate limits, quotas, safety filters, or access controls;
  • Upload malware, run attacks, or interfere with the Service's operation; or
  • Violate the terms of any third-party platform you connect (including TikTok, Instagram, YouTube, X, Shopify, and Etsy).

We may remove content, suspend, or terminate accounts that we reasonably believe violate these rules.

6. Third-party platforms and models

The Service integrates with third-party platforms and AI model providers. Your use of those services is governed by their own terms. We are not responsible for the availability, content, policies, rate limits, or actions of those third parties. If a third party changes its terms, pricing, or access, features that depend on it may change or stop working.

When you connect a third-party account, you authorise us to access and act on that account on your behalf (for example, to post scheduled content). You can disconnect at any time from your account settings.

7. Fees and billing

Some features require a paid monthly subscription. Prices, plan features, and usage limits will be shown before you subscribe and may change with notice for the next billing period.

Payments are processed by Stripe, our third-party payment provider. By subscribing you also agree to Stripe's terms and privacy policy. We do not see or store your full card details.

Subscriptions renew automatically each month until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you will retain access until then. Unless stated otherwise or required by law, fees already paid are non-refundable, including for partial months. You are responsible for any taxes that apply to your purchases.

If a payment fails, we may retry it, suspend paid features, or downgrade your account. If you are a consumer in the UK or EU, your statutory cancellation and refund rights are not affected by this section.

8. Beta and experimental features

Some features may be labelled alpha, beta, preview, or experimental. These are provided "as is", may be changed or withdrawn at any time, and are excluded from any service commitments.

9. Intellectual property in the Service

The Service, including its software, design, logos, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service beyond the limited right to use it in accordance with these Terms.

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction.

10. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access at any time, with or without notice, including if we reasonably believe you have breached these Terms, created legal or security risk, or if providing the Service is no longer commercially viable.

On termination, your right to use the Service ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that AI output will be accurate, complete, or fit for any specific purpose.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; for loss of profits, revenue, data, goodwill, or business opportunities; or for any damages arising from your use of the Service, Your Content, AI output, or any connected third-party platform.

Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) £100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Rights Act 2015 where it applies to you as a consumer.

13. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will let you know (for example, by email or an in-product notice) before they take effect. Continued use of the Service after changes become effective means you accept the updated Terms.

15. Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. You and we agree to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident elsewhere in the UK or the EU, you may also bring proceedings in the courts of your place of residence, and mandatory consumer-protection laws of that jurisdiction will apply.

16. Miscellaneous

These Terms are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
